While the Biden administration had issued guidance to ensure women could obtain emergency abortions in life-threatening situations, the Centers for Medicare and Medicaid Services (CMS) has announced it would revoke this guidance. CMS asserts that the law requires hospitals to provide stabilizing treatment regardless of state restrictions, although this revocation raises concerns about whether hospitals will continue to face accountability for not offering necessary care.

Legal experts indicate that stringent abortion laws in Texas intimidate medical staff from providing essential treatments even when the patient’s life is in danger. Thurman fears that pregnant patients with severe complications may not receive proper assistance in Texas emergency rooms, highlighting a broader issue of access to care in states with strict anti-abortion laws.
