Arizona Doctors Challenge Abortion Restrictions in New Lawsuit

In a significant legal battle, Arizona doctors have filed a lawsuit aimed at overturning restrictions that they argue hinder access to abortion care. This comes on the heels of Proposition 139, passed by Arizona voters last year, which enshrined the right to abortion until fetal viability in the state constitution. Gail Deady, a senior attorney at the Center for Reproductive Rights, emphasized that existing laws limiting access must be challenged for Proposition 139’s protections to take effect.

The lawsuit seeks to eliminate what Deady describes as "onerous restrictions" lacking medical justification. Among these are laws that compel doctors to refuse care based on suspected genetic diagnoses, impose a mandatory 24-hour waiting period, and restrict telehealth consultations. The complaint also highlights Arizona’s "two-trip" law, requiring patients to visit clinics twice to receive state-mandated information, often spreading misinformation.

As the lawsuit unfolds, the state Attorney General’s office is reviewing the complaint, while conservative advocates have yet to publicly respond. Deady warned that current restrictions delay access to care that the majority of Arizonans support, urging immediate action to restore reproductive rights in the state.
