Arizona Supreme Court to Review Donor Disclosure Rules Impacting Republican Groups
PHOENIX — The Arizona Supreme Court has agreed to hear arguments from conservative groups seeking to safeguard donor anonymity in campaign funding. In a significant order, the court will review a claim by the Center for Arizona Policy and the Arizona Free Enterprise Club that the disclosure laws ratified by voters in 2022 violate the state’s free speech provisions. The Goldwater Institute represents these groups, arguing that Arizona’s constitution offers broader privacy protections than the First Amendment.
Proposition 211 mandates the public disclosure of donors who contribute over $5,000 to organizations spending more than $50,000 on campaigns. This law aims to reveal the sources of significant funding, especially amid concerns about undisclosed influences in elections.
While the Goldwater Institute has received a hearing opportunity, the court has not guaranteed a reversal of previous lower court rulings affirming the law’s constitutionality. The Institute argues that public disclosure of contributors could lead to harassment, thus infringing on the right to privacy.
